Amanda places an advertisement in her local newspaper that reads:
“inflatable kayak for sale, good as new, £500”. She includes her e-mail
address. The advert appears in the newspaper on Monday.
Billy reads the advert in the newspaper on Monday and immediately
emails Amanda, saying: “I saw your advert about the kayak. I’m very
interested. It’s an excellent price; does it include delivery?” Amanda
responds by email on Wednesday morning, saying: “It’s yours…delivery
included. I can get it to you by tomorrow.”
On Tuesday, Amanda’s former classmate, Chris, hears she is selling the
kayak. He rings her and leaves a voicemail saying: “Hi Amanda, it’s
about the kayak you’re selling. I’ll take it for £450 – think that’s an
appropriate friend discount. I’ll send you a cheque.” Chris puts into
Amanda’s home letterbox a cheque for £450 on Wednesday and a note
that reads: “Thanks again for the kayak, my dearest friend!”
Daniel emails Amanda on Wednesday afternoon to say, “I’ll take your
kayak for £550. May I collect it today?” Amanda responds with her home
address. Daniel collects the kayak on Wednesday evening.
Unfortunately, when he tries out the kayak for the first time, it capsizes.
Daniel discovers that in fact it does not fully inflate and has significant
wear and tear.
On Thursday, Amanda receives a letter from Ellen that reads, “I will take
the kayak for £600 if you can deliver it to me by tomorrow.” Ellen posted
the letter on Tuesday, which she can prove.
Advise the parties as to their legal rights and obligations.
NOTE:
Our university uses Turnitin, a web-based application to facilitate online
assignment management including collection, marking, and feedback. It

to view the ‘originality’ report on your formative assessment to help you
learn about the importance of good academic practices and good
referencing.
Students are reminded of the importance of submitting this assessment. The
word limit for this assessment is 3,500 words including footnotes but excluding
bibliographies. Students are also reminded about the rules on plagiarism and
the rules on academic misconduct
